北市廉委會調查大巨蛋案，認為事涉刑事犯罪，昨決議將大巨蛋案移送法務部。法務部表示，該部不是偵查機關，無法受理案件，只能收到資料後轉請相關單位處理；至於廉政署則強調，該署已簽分「廉立案」，並指示台北市政風處蒐報資料，儘速呈報廉政署處理。
廉政署官員透露，北市廉委會不是正式機關，而是市府體制外的「黑機關」，既無案件移送權，調查報告也無法律效力，其調查結論是否有證據力令外界存疑。因此，廉政署不會依廉委會報告，作為主要辦案依據。
官員說，市長柯文哲若要將廉委會報告移送廉政署偵辦，廉政署予以尊重。另如果廉委會委員具名向檢察官、廉政署告發，廉政署也會依法處理。
